Terms of Service

By accessing or using IslandSpots ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Platform. These Terms constitute a binding legal agreement between you and IslandSpots ("we", "us", "our").

We reserve the right to update these Terms at any time. Material changes will be notified via email and a notice on the Platform. Continued use after changes take effect constitutes acceptance of the new Terms. The date of the most recent revision is shown at the top of this page.

IslandSpots is a marketplace platform that connects travellers with local activity operators on the Canary Islands and beyond. Travellers can browse activities and contact operators directly. Operators can purchase a "Spot" — an exclusive featured placement on an activity page — via a monthly subscription.

IslandSpots acts as an intermediary and does not provide, operate, or control any of the activities listed on the Platform. All activities are provided by independent third-party operators. We do not employ, endorse, or guarantee the quality of any operator.

• IslandSpots is a listing and lead-generation platform only.
• We do not process bookings, payments for activities, or handle customer disputes between travellers and operators.
• Operators are solely responsible for fulfilling any commitments made to travellers.
• We do not charge travellers any fees. The Platform is free for travellers to browse.

Operators may purchase a Spot on the Platform through a monthly or yearly subscription. The subscription grants the operator exclusive featured-operator status on a specific activity page for the duration of the subscription period.

The following terms apply to all subscriptions:

• Pricing: Monthly and yearly subscription prices are displayed at checkout. Prices exclude VAT, which will be added where applicable (B2B standard).
• Payment: Subscriptions are billed in advance on the first day of each billing period via Stripe. Accepted payment methods include major credit and debit cards.
• Automatic renewal: Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Price changes: We may adjust subscription prices with 30 days written notice. The price change applies to the next billing period.
• Taxes: Operators are responsible for providing accurate VAT/tax information. IslandSpots will issue valid invoices for all payments received.

Operators may cancel their subscription at any time through the Stripe Customer Portal or by contacting us. Cancellation takes effect at the end of the current billing period. There are no partial refunds for unused portions of a billing period.

• Monthly subscriptions: Cancel anytime. Access continues until the end of the paid month. No refunds for partial months.
• Yearly subscriptions: Cancel anytime. Access continues until the end of the paid year. No refunds for partial years, except where required by applicable consumer law (EU Consumer Rights Directive 2011/83/EU).
• Service cancellation by IslandSpots: We reserve the right to cancel any subscription immediately if an operator violates these Terms. In such cases, a prorated refund will be issued for the remaining period.
• Freezing: Subscriptions cannot be paused or frozen. To take a break, cancel and resubscribe when ready.

As a business on IslandSpots, you agree to:

• Accuracy: Provide accurate, current, and complete information about your business, including business name, contact details, and service descriptions.
• Availability: Ensure your business is open and accepting customers during the periods your Spot is active. Extended closures must be communicated to us.
• Response: Respond to traveller inquiries in a timely and professional manner. Poor response rates may result in removal of your Spot.
• Compliance: Comply with all applicable laws and regulations governing your business, including local business licensing, tax registration, and consumer protection laws.
• Professional conduct: Treat all travellers with respect. Discrimination of any kind is strictly prohibited and will result in immediate termination.
• No solicitation: Do not use the Platform to direct travellers to competing services or to solicit off-platform payments.

The following activities are strictly prohibited on the Platform:

• Listing illegal, dangerous, or misrepresented activities.
• Using the Platform for any fraudulent purpose or in connection with any criminal activity.
• Attempting to circumvent our subscription system or payment processing.
• Scraping, crawling, or otherwise extracting data from the Platform without our written consent.
• Impersonating another person or entity, or falsely representing an affiliation.
• Posting false, misleading, or defamatory content about other operators or travellers.
• Violating any applicable local, national, or international law.

Violation of these prohibitions may result in immediate termination of your account without refund and, where appropriate, referral to law enforcement authorities.

To the maximum extent permitted by applicable law:

• IslandSpots provides the Platform on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Platform's operation, availability, or fitness for a particular purpose.
• IslandSpots is not liable for any interactions, agreements, or disputes between operators and travellers. All activity bookings, payments, and service delivery are solely the responsibility of the operator.
• Our total liability to any operator for all claims arising from or relating to these Terms or the Platform is limited to the total subscription fees paid by that operator in the 12 months preceding the claim.
• In no event shall IslandSpots be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or loss of business opportunity.
• Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

The IslandSpots name, logo, design, and platform code are our intellectual property. You may not use them without our prior written consent.

Operators retain full ownership of their business name, logo, images, and descriptions. By listing content on the Platform, you grant us a non-exclusive, royalty-free license to display that content for the purpose of operating the Platform.

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.

For EU consumers, nothing in these Terms affects your statutory rights under the laws of your country of residence, including the right to access out-of-court dispute resolution under the Online Dispute Resolution (ODR) Regulation (EU) 524/2013.
